Description:
The presentation will describe the saga of an acquisition through condemnation by the U.S. of a property within the boundaries of the National Test and Training Range in Nevada. Spanning a number of years, the pre-trial activities included a number of appraisals, appraisal reviews and work by additional experts on both sides. The extensive pre-trial work, including depositions, law and motion practice, sets the stage for the ultimate trial. We will discuss the valuation positions taken by the two sides, the results of pre-trial motions and their impact on the case and the final verdict, along with the reasoning of the commission that heard the matter. Finally, we will discuss some key takeaways from the story.
